The “Canada Prohibition of Certain Toxic Substances Regulations 2012” (SOR/2012-285) officially came into effect on March 15, 2013, replacing the previous “Canada Prohibition of Certain Toxic Substances Regulations 2005”. The regulation is a tool for managing and controlling the risk of multiple substances, aimed to prevent potential risks of harm to the Canadian environment and human health by prohibiting the manufacture, use, sale, offer for sale or import of the 26 toxic substances, and products containing them (with a limited number of exemptions).
In addition, the proposed “Canada Prohibition of Certain Toxic Substances Regulations, 2022” were published in the Canada Gazette on May 14, 2022. The proposed Regulations mainly add prohibition on the manufacture, use, sale, offer for sale or import of Dechlorane Plus (DP) and Decabromodiphenyl ethane (DBDPE) and products containing them on the basis of existing regulations. The proposed Regulations would repeal and replace the “Canada Prohibition of Certain Toxic Substances Regulations, 2012” on the day the final Regulations come into force.
In view of the regulations which not only target certain toxic substances, but also cover products containing these substances, the enterprises involved in exporting products to Canada need to clarify the compliance of their products with this regulation. Meanwhile, as the “Canada Prohibition of Certain Toxic Substances Regulations” continue to be updated, more and more toxic substances will be controlled. Therefore, relevant enterprises should also pay close attention to the updates of regulations and be prepared to respond.
